Terms of service

These Terms govern access to VayaZoom.com and purchases from the store. “VayaZoom,” “we,” “us,” and “our” refer to the online store using the VayaZoom trading name and the address 3285 Southern Ave, Memphis, TN 38111, United States. By using the site or placing an order, the customer agrees to these Terms, the Privacy Policy, the Return and Refund Policy, the Shipping and Delivery Policy, and any product-specific terms disclosed before purchase.

Nothing in these Terms excludes or limits a consumer right that cannot legally be excluded. If a mandatory law conflicts with these Terms, the mandatory law controls to the extent of the conflict.

A customer must have legal capacity to enter into the transaction or use the store with the involvement of a parent or legal guardian where permitted. Account information must be accurate and kept secure. The account holder is responsible for activity performed using credentials under their control and should notify VayaZoom promptly of suspected unauthorized access.

VayaZoom aims to describe products accurately. Screen settings, lighting, packaging updates, and manufacturing tolerances can affect appearance. Dimensions and specifications are approximate unless expressly stated as exact. Product images are illustrative but must not materially misrepresent the item sold.

Availability is not guaranteed until an order is accepted and fulfilled. VayaZoom may limit quantities, discontinue products, or correct genuine listing errors. If a product is unavailable after payment, VayaZoom will notify the customer and issue an appropriate refund or offer an alternative that the customer may accept or reject.

Prices can change before an order is placed. The price and charges shown in the final checkout review apply to the order, subject to correction of an obvious error. Applicable taxes, shipping charges, and discounts will be presented before payment where VayaZoom collects them. Cross-border duties or taxes not collected at checkout may be payable by the recipient as described in the Shipping Policy.

Promotions are subject to their stated conditions, availability, dates, exclusions, and quantity limits. Unless expressly permitted, offers cannot be combined, exchanged for cash, or applied retroactively.

Submitting an order is an offer to buy. An automated acknowledgement confirms receipt but does not necessarily mean the order has been accepted. VayaZoom may verify payment, inventory, delivery information, fraud risk, and legal restrictions before acceptance. Acceptance occurs when VayaZoom sends a shipment confirmation or otherwise expressly confirms fulfillment.

VayaZoom may refuse or cancel an order for legitimate reasons, including unavailable inventory, payment failure, suspected fraud, inaccurate information, abusive conduct, sanctions or export restrictions, pricing errors, or quantity limits. If an order is cancelled after payment, VayaZoom will refund the amount due.

The customer authorizes VayaZoom and its payment providers to charge the selected payment method for the order total. Billing and contact information must be current, complete, and accurate. Payment methods are those displayed at checkout and can vary by location. Additional terms appear in the Payment and Billing Policy.

Delivery estimates, shipping charges, customs information, and delay procedures are governed by the Shipping and Delivery Policy. Returns, cancellation rights, exceptions, exchanges, and refund timing are governed by the Return and Refund Policy. Those policies form part of these Terms.

Users must not use the site to break the law; infringe intellectual-property, privacy, publicity, or contractual rights; transmit malware; probe or bypass security; scrape or overload the service without authorization; impersonate another person; submit fraudulent payment or identity information; interfere with another customer; or use content from the store for unauthorized commercial exploitation.

VayaZoom may restrict access, cancel an affected order, preserve evidence, or report conduct when reasonably necessary to protect the store, customers, providers, or the public.

The site’s original text, design, graphics, logos, organization, and other content are owned by or licensed to VayaZoom and are protected by applicable intellectual-property laws. A limited, revocable, non-transferable permission is granted to use the site for personal shopping and lawful interaction with VayaZoom. No ownership right is transferred.

Third-party product names, trademarks, images, and specifications belong to their respective owners. Their appearance does not imply endorsement beyond the lawful sale or description of the relevant product.

A user who submits a review, photograph, comment, or other content confirms that the submission is truthful, lawful, and not confidential; that the user has the necessary rights; and that it does not infringe another person’s rights. The user grants VayaZoom a non-exclusive, worldwide, royalty-free license to host, reproduce, display, moderate, and use the submission in connection with the store and its marketing, subject to applicable privacy and consumer-review laws.

VayaZoom may remove content that is unlawful, irrelevant, fraudulent, abusive, or violates these Terms, but does not promise to monitor every submission. Incentivized reviews must be clearly disclosed and may not be conditioned on a positive opinion.

The store relies on Shopify and may link to payment providers, carriers, social networks, or other independent services. VayaZoom is not responsible for an independent third party’s content or separate practices, although VayaZoom remains responsible for its own obligations and cannot avoid mandatory consumer duties merely by using a supplier, carrier, or processor.

To the fullest extent permitted by law, the website is provided on an “as available” basis and VayaZoom does not guarantee uninterrupted access or that every non-material error will be corrected immediately. Product warranties are limited to those expressly stated and those implied by mandatory law.

This clause does not exclude warranties, guarantees, remedies, or quality standards that cannot be disclaimed, including applicable UK rights for goods to be of satisfactory quality, fit for purpose, and as described.

To the fullest extent permitted by law, VayaZoom is not liable for indirect or consequential losses that were not reasonably foreseeable when the contract was formed, or for business losses arising from a consumer purchase. Where liability can lawfully be limited, VayaZoom’s aggregate contractual liability will not exceed the amount paid for the affected order.

Nothing in these Terms limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence where such liability cannot be excluded, deliberate misconduct, or any other liability or consumer remedy that applicable law does not permit VayaZoom to limit.

To the extent permitted by law, a business user or person using the site unlawfully agrees to reimburse VayaZoom for reasonable losses arising directly from that user’s material breach, infringement, fraud, or malicious interference. This clause does not impose an unfair indemnity on a consumer for exercising lawful rights.

VayaZoom may suspend or terminate access for a serious or repeated breach, fraud, security risk, or unlawful activity. Provisions that by their nature should survive termination, including payment obligations, intellectual-property rights, liability limits, and dispute provisions, remain effective.

For customers in the United States, these Terms are governed by the laws of the State of Tennessee and applicable federal law, without regard to conflict-of-law principles. Subject to any mandatory right to sue elsewhere, disputes may be brought in the state or federal courts serving Shelby County, Tennessee.

For consumers in England and Wales, Scotland, or Northern Ireland, the mandatory consumer laws of the customer’s home jurisdiction remain applicable. A UK consumer may bring proceedings in the courts of the part of the United Kingdom where the consumer lives where the law provides that right. Before litigation, both sides should make a good-faith effort to resolve the concern through the contact methods below.

VayaZoom may revise these Terms prospectively. The version presented when an order is placed governs that order unless a change is required by law or agreed with the customer. If a provision is unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue to apply.
